Terms of Service

1. Agreement Between Deal Intake and the Dealership
These Terms of Service ("Terms") govern the use of the Deal Intake platform ("Service") by a licensed vehicle dealership ("Dealership," "you") that has entered into a subscription or services agreement with Deal Intake. The Service is a business tool made available to the Dealership; individuals who complete the intake flow (the Dealership's customers) are not parties to these Terms.
2. Acceptable Use
- The Dealership will use the Service only for legitimate vehicle financing intake and pre-approval workflows with its own customers.
- The Dealership is responsible for obtaining any consents required from its customers before submitting their information, and for the accuracy of information its staff enter into the Service.
- The Dealership will not use the Service to process applications on behalf of individuals who have not given informed consent to the soft credit pull and document collection described in the Privacy Policy.
- The Dealership will not attempt to circumvent the Service's security controls, access other dealerships' data, or reverse engineer the Service.
3. Not a Lender or Credit Bureau
Deal Intake is a workflow and decisioning-support tool. Deal Intake is not a lender, credit bureau, or extender of credit, and does not itself approve or deny financing. The soft credit pull result and the debt-to-income (DTI) based pre-approval estimate produced by the Service are informational only. Actual lending decisions, credit terms, and approvals rest solely with the Dealership and the third-party lenders it works with. Nothing in the Service constitutes an offer of credit.
4. Liability Disclaimers
- The Service is provided "as is" without warranties of any kind, express or implied.
- Deal Intake does not guarantee that any customer will be approved for financing, or that a pre-approval estimate will match a final lending decision.
- Deal Intake relies on third-party data sources, including credit bureau data from Equifax Canada, and does not guarantee the accuracy, completeness, or timeliness of that data.
- To the maximum extent permitted by law, Deal Intake's aggregate liability arising from use of the Service is limited to the fees paid by the Dealership for the Service in the twelve (12) months preceding the claim.
5. Termination
Either party may terminate the Dealership's access to the Service as set out in the applicable services agreement, or immediately if the Dealership breaches these Terms, including by misusing customer data or using the Service without proper customer consent. Upon termination, the Dealership's access to the Service will be discontinued; data retention following termination is handled in accordance with the Privacy Policy and any applicable data processing agreement.
6. Governing Law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. This is a placeholder jurisdiction and should be confirmed by counsel for your specific business arrangement.
